OpenAI Files Counterclaim Demanding Musk Cease Unlawful and Unfair Conduct
The dramatic lawsuit between OpenAI and Elon Musk shows no signs of abating. In a filing on Wednesday, lawyers for OpenAI, its CEO Sam Altman, and other defendants in the case asked the court to bar Musk from taking "further unlawful and unfair actions" and hold him liable for damages caused to the defendants. OpenAI stated in the counterclaim filing, "OpenAI is resilient, but Musk's actions have caused harm. If his actions continue, even greater harm will ensue. Musk's ongoing attacks on OpenAI, most recently in the form of a bogus takeover offer, are designed to disrupt OpenAI's future development and must cease." Musk had originally sought a preliminary injunction to prevent OpenAI from transforming into a for-profit company. However, in March, the judge denied his request but allowed the case to proceed to a jury trial in the spring of 2026.
